Buccleuch Masjid Dispute Settled Out of Court

A case against a Buccleuch masjid north of Johannesburg has been settled out of court.
 
The matter which was meant to be heard on Tuesday was finally settled today after a proposal of settlement terms was submitted by the Advocate for Buccleuch Residents Action Community NPC Patrick Mundell to the Mufti Ebrahim Sanjalvi Waqaf Trust.

Advocate Yakoob Alli representing the Mufti Ebrahim Sanjalvi Waqaf Trust says the main objection to the masjid centered around the parking for congregants and the impact of the traffic congestion it would create.
 
“The essence of the settlement was that they acquired a piece of land across the road from the mosque that would serve as additional parking and the arrangement would be notarially registered.”

Alli says there was also a monatery settlement towards the legal fees incurred by the Buccleuch Residents Action Community during the case as they are a non-profit organisation.  

“There was a R 70,000 contribution to the Buccleuch Residents Action Community towards their costs. The mosque was happy to give that contribution towards the cost as against taking this fight on and carrying it forward.”

Alli says it’s heartening that the two parties were able to reach a mutually settlement agreement.
 
“Our communities and our suburbs are becoming much more diverse these days and tolerance is important always in these sorts of debates and with some engagement it has been shown that we can actually find solutions that would cater to everyone’s concerns.”
