[LISTEN] AfriForum to Get Mandamus if NPA Fails to take Decision to Prosecute Malema

AfriForum says it wants the National Prosecuting Authority (NPA) to take a decision to prosecute Economic Freedom Fighters (EFF) leader Julius Malema for three cases he is involved in.

The lobby group has accuses the NPA of making Malema irrationally feel he’s untouchable by refusing to prosecute him.

AfriForum briefed media on Wednesday morning highlighting the various cost orders the organisation has won against the EFF and its leader.

Head of AfriForum’s private prosecutions unit, Advocate Gerrie Nel says the unit got involved due to the “the irrational decision of the NPA not to follow or withdraw from the prosecution”.

“It’s one of those strange things and that is take a decision because the inability or the lack to take a decision makes it impossible for justice to proceed because nobody else can take any further decisions on this matter.”

Nel says if the NPA fails to take a decision on Malema, AfriForum would approach the court for a mandamus, which is an order to direct any public official to do their job and take a decision.
